PARKING ALLOWED ONLY IN FRONT OF MANUFACURED HOME IN DESIGNATED PARKING AREA.

Any other amenities or services offered by the Landlord but not specifically set forth hereunder, are not part of this Agreement and Landlord shall have no responsibility to maintain or continue the same.

Upon execution of this Agreement, Tenant acknowledges he/she has inspected both the Space Leased, and the amenities herein leased and accepts same as in good repair and condition.

2. MANUFACTURED HOME The Manufactured home for which the above space is leased is as follows:

3. LEASE TERM Initial(s) _________________________
The term of this Lease Agreement shall be for One (1) Year commencing on the _________day of _________________________, ________________ until terminated.

4. RENT, PAYMENT AND CHARGES Initial(s) __________________________
A. Rent for the leased space is payable monthly in advance on the first (1) day of each calendar month.
B. The rent amount due for the leased space shall be three hundred fifty dollars ($350.00) per month.
C. The first month's rent may be prorated.
D. Partial payment of rent (as defined in this Article and Article 4) will not be accepted by the park, and failure to pay the entire amount of rent when due constitutes a breach of the rental agreement. The monthly base rent may be increased according to Nevada Revised Statute 118B.
E. Rent may be paid by check, draft, or money order payable to Wendover Mobile Home Park. Park, LLC and delivered to 715 Poplar Street in Wendover Mobile Home Park.
The Manager lives at that address and there is a drop box available at the address.

The terms "Park" and "Manager" may be interchangeable in this Lease Agreement. Initial(s) ___________________________
F. In the event the monthly rent is not paid in full or before the fifth day (5th) of the month, an additional late fee of fifty dollars ($50.00) will be charged and added to the rent due. Initial(s) ___________________________
G. The tenant(s) will be charged an additional ten dollars ($10.00) late fee for each week of the month that rent or late fees are still due. The ten dollars ($10.00) additional late fee will continue until all the late fees and rent due are paid in full. Initial(s) ___________________________
H. A service charge of fifty dollars ($50.00) will be imposed for each dishonored check for any reason. Dishonored checks cannot be re-deposited and must be replaced by a cashier's check or money order. The replaced funds must include the fifty dollars ($50.00) service charge and applicable late fee due when the cashier’s check or money order is presented. The Park will refuse personal checks in the event the Tenant has two checks that are dishonored.

5. MANUFACTURED HOME PLACEMENT Initial(s) ____________________________
A. The park manager will direct the placement of the home onto the leased space. The Tenant must place the home exactly as directed.

6. TIE DOWNS Initial(s) ____________________________
A. Tie Downs are REQUIRED for all homes placed in the park. Manufactured Homes must be securely tied down the same day the manufactured home is placed in the park. NO Exceptions!
B. Cinder or concrete blocks must be used for blocking and leveling the home.
C. Heat Tapes MUST BE INSTALLED AS DEEP INTO THE GROUND AS POSSIBLE.
D. Removal of tires and axels is optional but preferred. The tongue should be removed if permissible by the manufactured home.
E. Manufactured Home Installations and Tie Downs must be inspected and approved by the city of West Wendover Building Department.
F. A COPY OF THE INSPECTION REPORT MUST BE PRESENTED TO THE PARK MANAGER PRIOR TO THE OCCUPANCY OF THE HOME.

7. SKIRTING Initial(s) ____________________________
A. Skirting is required and must be installed within 15 days of placement in the park.
B. Skirting must be VINYL, STEEL, OR A DURABLE SUBSTITUTION.
NO wood, plywood, wafer board, or particle board skirting is permitted to be used.
C. Skirting may be white, or a color that matches the manufactured home.
D. Skirting repairs must be made within 10 days following the damage.

8. SHEDS Initial(s) ____________________________
Construction must be approved in writing by the Park Manager before work commences.
The shed must be temporary structure. No permanent foundations allowed.
A. Material: Must be metal or wood.
B. Size: Must be approved by Park Manager
C. Color: Must be natural wood, white or a color matching the trailer.
D. Location: Location will be designated by the Park Manager.
E. The shed and the materials associated with the shed are required to be removed at the termination of the lease.
Additionally, the area under the shed will be restored to its original condition unless specifically waived in writing by the Park Manager.

9. DECKS AND AWNINGS Initial(s) ____________________________
Additions to a manufactured home must be approved in writing by the Park Manager. All requests must be in writing and accompanied by a sketch of the proposed addition to ensure an accurate description. Once approved by the Park Manager, the tenant must take approved drawings to the City of West Wendover to obtain a building permit. The Park Manager must receive a copy of the permit before work commences.

10. FENCES Initial(s) ____________________________ The Tenant must submit in writing a drawing showing the placement and construction materials of the fence to the Park Manager. The Park Manager must give written approval of the fence before construction may begin.
• The maximum height of any fence is Four (4) feet.
• Fences may be chain link or wood only.
• No plywood, particle board, wafer board, or wooden pallets allowed.

11. SERVICES AND UTILITIES Initial(s) ___________________________
Tenants are responsible for their own utilities and services.

12. USE AND OCCUPANCY Initial(s) ___________________________
The leased lots may ONLY be used for private residential purposes. No business, commercial activity, or DRUG DEALINGS of any sort will be conducted within Wendover Mobile Home Park, LLC premises, including the Tenants leased space.
ONLY people on the lease and their minor children may live in the Manufactured Home on the leased space.

Any person living on the premises more than fourteen (14) days in a calendar year MUST apply and be approved by the park Manager for tenancy in the manufactured home. Additional tenants will be required to sign a lease agreement.

13. RESTRICTION ON PETS Initial(s) ____________________
A. Only two (2) pets allowed per leased space.
B. The park will only allow leashed pets outside the Tenant's home. A Tenant MUST be with the pet(s) if the pet(s) is outside the tenant’s home.
C. No Exotic Pets (snakes, reptiles, etc.)
D. No Chickens, pigs, ducks
E. No breeding pets allowed on the space leased or in the manufactured home.
F. Pet(s) shall not disturb the peace and enjoyment of the other tenants.
G. All Pet waste shall be immediately and properly disposed of by the Tenant. The Tenant will be fined a hundred dollars ($100.00) for pet waste that is not removed promptly.
H. All dogs and cats shall be registered with the City of West Wendover and Park Manager, including name of the animal, breed, and current license number and current vaccination certificate.
I. The Tenant shall provide Park Manager with a copy of license and vaccinations annually.
J. All animal owners shall obey all state and local laws relating to the permitted use of animals.
K. Pets that are barking constantly, causing a nuisance, or not taken care of properly (food, water, and medical treatment) the Park Manager will contact the City of West Wendover Animal Control Officer or City of West Wendover Police Department. Any expense incurred by such an action is the responsibility of the Tenant.

14. CHILDREN Initial(s) _________________________________
Tenants will be held responsible for all the activities of the minor children residing with the tenants. This includes supervising the children to ensure their safety and that nothing disrupts the quiet enjoyment and use of the park by other tenants.

Tenants will also be held responsible for children of any guest the Tenant has on Wendover Mobile Park property.

15. NOISE Initial(s) _________________________________
The Tenant shall not make any unreasonable noises or sounds that may disturb the reasonable peace and enjoyment of the other Tenants.
This includes, and is not limited to, barking dogs, garden or lawn equipment, automobile exhaust systems, power generators, sound systems, car stereos, televisions, etc.
THE FOLLOWING HOURS ARE CONSIDERED QUIET TIMES.
These hours will be enforced by the Park Manager.
• Sunday through Thursday 10:00 PM to 8:00 AM
• Friday and Saturday 11:00 PM to 9:00 AM

16. VEHICLES Initial(s) ______________________
A. ONLY two (2) vehicles allowed per leased space. The vehicles must be registered with the park.
Registration includes the make, model, and license plate of each vehicle.
B. All vehicles shall be licensed and in working order.
C. Absolutely NO storage of junk vehicles or parts of any kind on the leased space.
D. NO restoration or major repairs of vehicles on Wendover Mobile Home Park property.
E. Parking or the use of Recreational Vehicles are not permitted in Wendover Mobile Home Park.
F. No on-site storage of motor homes, trailers, campers, cars, trucks, snowmobiles, or go‐carts.
G. NO OVERNIGHT ON-STREET PARKING.
H. If the Tenant(s) would like additional space to park, the Tenant must request a space from the Park Manager.
The Park Manager may, at their discretion, lease a space to the Tenant.
The cost for an additional parking space is fifty dollars ($50.00) per month FOR EACH VEHICLE.

The parking space rent is due in advance on the first day (1st) of the month. If granted additional space, the Tenant MUST register the vehicle with the park including Make, Model, and License plate.
I. If the tenant, or a guest of the tenant, park anywhere but the designated parking area for the leased space or on the street properly, the Tenant will be liable for any water line damage and the Tenant will be billed for the repair.
Wendover Mobile Home Park will NOT be liable for any additional water charges because of negligent parking by the Tenant or a Tenant’s guest.
J. Speed Limit inside the park is five miles per hour (5 MPH). The speed limit will be strictly enforced!

17. LANDSCAPING AND MAINTENANCE Initial(s) _____________________
A. Tenant shall maintain Tenant's Lease space in a clean, well kept, attractive fashion, including front, sides, and back. No landscaping is allowed without the written permission of the park manager. All areas are to be kept free of weeds. If any leased space is neglected, the Park reserves the right to take over its care and bill the Tenant for these services at a rate of fifty dollars ($50.00) for each hour services are rendered.
B. Tenants shall not store, collect, or keep upon leased space any materials except standard patio furniture and/or patio grills.
NO inoperable, unlicensed, or "junk" vehicles may be stored, parked on the leased space, or any other vacant areas in the park.

18. ASSIGNMENT, SUBLETTING, AND RENTING Initial(s) ___________________
The Tenant shall not assign or sublet the premises or any part thereof without the prior written consent of Wendover Mobile Home Park. The park reserves the right to refuse consent to any assignment or sublease and to require instead the Tenant's proposed assignee or sub-lessee enter into a separate rental agreement directly with the Park PRIOR to Park's approval.

LEASE AGREEMENT terminating this Lease Agreement. In the event the Park consents to sublease, the Tenant and the proposed sub-tenant shall be required to execute a Sub-Rental Agreement provided by the park. This provision shall apply whether Tenant has sold the manufactured home situated upon the premises and the proposed assignee or sub-lessee is the buyer of the Tenant's Manufactured home.

19. SALE OF MANUFACTURED HOME Initial(s) ___________________
A. Tenant may sell his/her home at any time pursuant to the rights and obligations of the Tenant and the Park under applicable law.
B. Tenant must notify the Park IN WRITING of the intention to sell his/her manufactured home.
C. THE PROSPECTIVE BUYER MUST DO THE FOLLOWING BEFORE OCCUPYING THE MANUFACTURED HOME:
1. Complete an Application for Tenancy
2. Be accepted by the park for Tenancy
3. Execute a Rental Agreement or another agreement for the occupancy of the Leased space
4. Execute and deliver to the park a copy of the Park's Updated effective Park Rules and Regulations and other residency documents
5. Upgrade or repair the manufactured home if it does not meet the Park standards
D. If the purchaser fails to comply with any of the foregoing steps or fails to execute the park's rental agreement,
he/she shall have no right to tenancy.
E. Any other occupant of the manufactured home must follow the same procedures to qualify for tenancy.

20. REMOVAL UPON SALE Initial(s) _________________________
The Park, in upgrading the quality of the park, may require the removal of manufactured homes from the Leased Space upon their sale to a third party, or terminate this Lease Agreement in accordance with the Rules and Regulations of the Park and NRS 118B. l 70.
Further, the park may require the new purchaser to upgrade and repair the manufactured Home to meet Park standards.

21. TERMINATION OF TENANCY BY PARK Initial(s) ____________________
The Park may terminate this Lease Agreement and demand the Tenant vacate the Leased Space and Park Premises for breach of the Lease Agreement or the Park Rules and Regulations. Any termination must be and will be conducted in accordance with Nevada Law. In the event that legal proceedings are initiated to enforce any of the terms and provisions of this Lease, the prevailing party shall be entitled to recover its attorneys’ fees and costs from the non-prevailing party.
GROUNDS FOR TERMINATION INCLUDE, BUT ARE NOT LIMITED TO:
A. Non-payment of rent or repeated failure to pay rent in a timely manner
B. Any conduct that annoys or interferes with other residents' peaceful enjoyment, or Management's ability to operate the Park, or violation of the Law or Ordinances
C. Failure to keep the Leased Space or Premises neat, clean, free of weeds and debris and orderly.

22. TERMINATION BY TENANT Initial(s) __________________
The Tenant may terminate this Lease Agreement, and the tenancy created hereunder by giving a minimum of thirty (30) days advance written notice of such termination, specifying the exact date thereof to the park.
Failure to give such notice shall result in the Tenant being charged for an additional month's rent.

23. MAINTAINING OR PERMITTING NUISANCE Initial(s) _____________
Tenant is advised that committing, maintain or permitting a public nuisance on Tenant's Leased Space and or premises is a public nuisance and may cause Tenant to be guilty of a misdemeanor.

24. REPORT OF A NUISANCE OR OTHER VIOLATIONS Initial(s)_____________
Report of nuisance violations or building, safety and health code violations may be made as follows:

25. FLAG DISPLAY
Tenant is permitted to display a flag of the United States from a pole, staff, or in a window.

26. OTHER RULES Initial(s) _________________________
A. Outside light poles will be maintained by park only.
B. No work will be performed on privately owned manufactured homes by the park.
C. Sewer and water problems will be repaired from the water meter to the connection shut off valve only.
D. The Tenant must turn in and a request for water reimbursement to the park manager within 60 days of the repair.
If the request is not received within the 60-day period, no reimbursement will be made to the Tenant.

27. NOTICE OF VIOLATIONS Initial(s) ________________________
A violation of the Lease Agreement shall be delivered in writing to the Tenant (or the Tenant’s door) at the designated Leased space.
Delivery of the written notice to Tenant or Adult at the designated space shall be presumed to be written notice to all the Tenants of the Leased Space.

LEASE AGREEMENT
Three (3) written violations within any 90-day period shall be a basis for eviction as a nuisance.

28. NRS 202.470 Maintaining or permitting nuisance:
Penalty. Every person who:
1. Shall commit or maintain a public nuisance, for which no special punishment is prescribed; or
2. Shall willfully omit or refuse to perform any legal duty relating to the removal of such nuisance; or
3. Shall let, or permit to be used, any building or boat, or portion thereof, knowing that it is intended to be, or is being used, for committing or maintaining any such nuisance, shall be guilty of a misdemeanor. [1911 C&P § 298; RL § 6563; NCL § 10246
